In S.B. 124 the Ohio Legislature clarified the application of the new recording requirements to include a common sense change.
Now the additional $20 fee shall not be applied to documents that do not comply with the margin requirements of Ohio Revised Code 317.114 as a result of the following:
- notary stamps, seals, signature or initial not meeting the minimum font size requirements
- the inclusion of incidental information that is not essential to the recording process or to the legal validity of instrument that may appear in either the side margin or bottom margin such as page numbers, trailing signatures, form codes and similar items.
This is a good correction it may help to have a copy of S.B.124 with you when recording documents until county recorders are made aware of this change.
